TERMS & CONDITIONS: PHILIPS PROMOTION

1. The Promotion is only open to individuals who are Singapore residents 18 years and above (“Participant”). Corporations, companies, body corporate bodies, groups, organizations and any other corporate bodies and non-corporate bodies are not eligible to participate. The promotion codes issued by the Promoter (“Promotion Code(s)”) are only applicable for use on the Promoter’s Singapore official website.

 

2. Employees, and the immediate families of the Promoter and of participating retailers and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child, step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

3. The following provisions apply to the Promotion Code(s) :

 

1. There is no free delivery/ shipping for products purchased using the Promotion Code(s) unless expressly stated otherwise.
2. Promotion Code(s) are not transferable or redeemable for cash and/or credit.
3. Promotion Code(s) cannot be used for sales items and/ or with any other promotions/ vouchers unless expressly stated otherwise.
4. The Promoter is not required to provide any vouchers, discounts, credits, cash or any other form of compensation for discontinued or cancelled Promotion Code(s).

1. Orders are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt. The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected Orders.

 

2. Subject to clause 6, incomplete Orders and Orders using Promotion Code(s) received after 4.00pm on [insert date 3] will be deemed invalid and will not be processed. Promotion Code(s) provided shall not apply retrospectively to orders placed prior to the Promotional Period.

 

3. The Promoter reserves the right to validate and check the authenticity of the order, and to disqualify any Participant for tampering with the order process, or who submits an order that is not in accordance with these terms and conditions. Breach of these terms and conditions will render any discount provided by the Promotion Code(s) void.
4. The Eligible Philips Products for this Promotion are as follows:

1. Orders can only be redeemed at participating stores/outlets.
2. These terms and conditions are subject to change by the Promoter.
3. The Promoter reserves the right to modify or cancel any order or revoke the use of any promotion code(s) for any reason including suspicious or fraudulent activities, misuse of the Promotion Code(s) or breach of these terms and conditions, without incurring any liability. The decision as to the right to use of the Promotion Code(s) will be at the complete discretion of the Promoter and no correspondence will be entered into.

1. The Promoter accepts no responsibility for any variation in price of the Product(s) from other suppliers.

2. If for any reason this Promotion is not capable of running as planned, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the process, and/or to cancel, terminate, modify or suspend the The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration in relation to the Promotion.

3. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to Participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Promotion.

 

4. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY SINGAPORE LAW.

5. LIABILITY, INDEMNITY AND RELEASE: In consideration for the Promoter accepting the Participant’s participation in the Promotion, to the fullest extent permitted by law, the Participant releases and forever discharges the Promoter from all claims that the Participant may have or may have had but for this release arising from or in connection with any participant’s participation in this Promotion. The Participant indemnifies and holds harmless the Promoter to the extent permitted by law in respect of any claim by any person (including but not limited to other Participants in the Promotion), arising as a result of or in connection with the Participant’s participation in the Promotion. For the purposes of this clause, claim(s) means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising.

6. The Promoter’s decisions are final and no correspondence will be entered into, including in the event of a dispute. The Products purchased must be taken as offered and cannot be varied.

7. Except for any liability that cannot by law be excluded, the Promoter and TP Vision Singapore Pte Ltd (including their respective officers, affiliated companies, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

8. The Promoter collects personal information (“PI”) in order to conduct the Promotion, and may for this purpose, disclose PI to third parties, including but not limited to agents, contractors and service providers and to any Government authorities and agencies. This Promotion is conditional on providing this PI.  In addition to any use that maybe outlined in the Promoter’s Privacy Policy, if the Participant opts-in by ticking the opt-in box at the time of submitting an Entry Form, , Participants consent to the information they submit with their Entry Form being entered into a database, of the Promotoer and/or its affiliate companies and this information may be used in any media, for an indefinite period, for future promotional, marketing, publicity, research and profiling purposes including sending electronic messages or telephoning the Participant, without any further reference or payment or other compensation to the Participant. All personal details of the Participant will be stored by the Promoter and/or its affiliate companies and is subject to TP Vision Singapore Privacy Policy.  A request to access, update or correct any information or to opt out of receiving any communications can be made through the Promoter’s website. By participating in this Promotion, the Participant consents to the overseas transfer of the PI on these terms as permitted herein and agrees not to hold the Promoter liable in this regard.

 

9. Any costs incurred by a Participant associated with entering the Promotion and/or claiming the products purchased, including accessing the TP Vision’s website, telephone enquiries in relation to the products are the sole responsibility of the Participant.

10. These Terms and Conditions constitute the entire agreement of the parties relating to the participation and the conduct of the Promotion.
